TERMS AND CONDITIONS OF USE OF THE DRUPPIFY PLATFORM
These Terms and Conditions of Use (hereinafter, the "T&C") govern the use of the technology platform DRUPPIFY (hereinafter, the "Platform" or "Druppify") by registered users (hereinafter, the "Druppers" or "User").
By registering and using the Platform, the User declares that they have read, understood and fully accepted these T&C, as well as Druppify's Privacy Policy .
1. DEFINITIONS
For the purposes of these T&C, the following terms shall have the meanings set out below:
- Drupper or User: A natural person who voluntarily registers on the Platform to access operational coordination opportunities published by Logistics Operators, without this implying the supply of personnel, labour intermediation or any contractual relationship with Druppify.
- Logistics Operator or Operator: A logistics company that uses the Platform to coordinate operational activities with registered Users. The nature of the relationship between the Operator and the User is the exclusive responsibility of both parties.
- Commercial Principal or Client: A company (e.g. supermarket, retailer, distribution centre) on whose premises the Drupper may provide services coordinated through the Platform.
- Druppify or the Platform: The technology system for the coordination, recording, monitoring and operational management of logistics services, owned by Sistemas Tecnológicos Osystems SpA, tax ID 76.967.436-5.
- Operational Roles: Categories of operational and logistics activities that the User may select on the Platform, including but not limited to: shopper, picker, driver, packer, warehouse operator, and any other role the Platform may add.
- Services: Operational coordination opportunities published by the Logistics Operator through the Platform, which the User may voluntarily accept or decline, without this constituting an obligation to perform, the imposition of working hours or any employment relationship with Druppify.
- Personal Data: User information recorded on the Platform, including name, email, telephone, address, identity documents, photographs and geolocation, among others.
- Operational Data: Information generated during the performance of operational activities coordinated through the Platform, including check-in/check-out records, GPS location, performance metrics, photographic evidence, digital signatures, and any other data required for operational traceability.
- Operational Evidence: Documents, photographs, signatures, location records and any other means of proving the operational activities recorded on the Platform.
- Payment Estimate: A NON-binding indicative calculation that the Platform may display, based on rates configured by the Operator and other operational parameters.
2. NATURE OF THE PLATFORM
2.1. Druppify is a technology platform that facilitates the coordination, recording and monitoring of logistics services between Operators, Commercial Principals and Druppers. Druppify acts SOLELY as a technology intermediary and does NOT directly provide material logistics services.
2.2. Druppify is NOT an employer of the User, nor a party to any relationship between the User and the Logistics Operator or Commercial Principal. Any relationship, terms, payments, insurance, tax and social security obligations are the exclusive responsibility of the User and the Logistics Operator, with Druppify neither intervening in nor being liable for the nature of that relationship.
2.3. Scope of the Platform: The Platform is provided as a technology tool for operational coordination, available in accordance with its technical and functional characteristics in force at any given time. Druppify does not guarantee the permanent availability of services, uninterrupted continuity of service, the generation of operational opportunities, or the achievement of any specific results by the User. The User acknowledges and accepts that access to and use of the Platform is subject to technical, operational and connectivity conditions outside Druppify's control, as well as to decisions and configurations defined exclusively by the Logistics Operators.
3. NO EMPLOYMENT RELATIONSHIP WITH DRUPPIFY
3.1. EXPRESS DECLARATION: The User declares and accepts that:
- There is NO relationship of dependency, subordination or any employment link between the User and Druppify.
- There is NO obligation of exclusivity nor working hours imposed by Druppify.
- The User is free to accept or decline services offered on the Platform.
- Druppify does NOT exercise powers of command, direction or functional supervision over the User.
- Any contractual or employment relationship of the User is with the Logistics Operator, NOT with Druppify.
3.2. Freedom to Accept: The User is entirely free to accept or decline services offered on the Platform.
3.3. User-Operator Relationship: The nature, terms and conditions of any relationship between the User and the Logistics Operator are the exclusive responsibility of both parties. Druppify does NOT define, characterise or intervene in that relationship.
3.4. Druppify does NOT process payments: Druppify does NOT make payments of any kind to the Drupper. Any financial compensation is the exclusive responsibility of the Logistics Operator.
4. SERVICE ROLES AND USER CHOICE
4.1. Role Selection: The User may select one or more service roles available on the Platform (shopper, picker, driver, packer, etc.), according to their experience, skills and preferences.
4.2. Requirements by Role: Some roles may require specific documentation (e.g. a driving licence for drivers, training certificates, etc.). The User undertakes to meet all the requirements of the selected role.
4.3. Changing Roles: The User may request to add or change their service roles at any time, subject to validation by the Operator and compliance with the requirements.
5. USER ACCOUNT AND ACCURACY OF DATA
5.1. Registration: To use the Platform, the User must create an account providing truthful, complete and up-to-date information, including:
- Full name
- Email address
- Telephone number
- Home address with GPS coordinates
- Identity document (national ID or passport) with photographs
- Driving licence (if applicable)
- Criminal record certificate
- Bank account details (to receive payments from the Operator)
5.2. Accuracy and Responsibility: The User is responsible for the truthfulness, accuracy and updating of their data. Druppify reserves the right to suspend or delete accounts holding false, incomplete or fraudulent information.
5.3. Account Security: The User is responsible for keeping their access credentials (email and password) confidential. Any activity carried out with their account shall be their exclusive responsibility.
5.4. Tax Responsibilities: The User declares that they are aware that, depending on the type of relationship they hold with the Logistics Operator, it may be necessary to comply with tax obligations such as registering their activity with the Chilean Internal Revenue Service (Servicio de Impuestos Internos, SII), which are their exclusive responsibility and unrelated to Druppify.
6. USE OF GEOLOCATION AND CAMERA
6.1. Geolocation (GPS): The Platform uses the geolocation of the User's mobile device for the following purposes:
- Capturing the home address: During registration or profile updating, the User may authorise the use of GPS to autocomplete their address through Google Maps.
The detailed processing of geolocation data, including specific operational events such as check-in, check-out and deliveries, is governed in full by the Druppify Privacy Policy.
6.2. Camera: The Platform requests access to the device camera in order to:
- Scan or photograph identity documents, driving licences and certificates.
- Generate photographic evidence during the performance of operational activities (e.g. delivery records, product condition, etc.).
6.3. Revoking Permissions: The User may revoke geolocation and camera permissions from their device settings at any time, but this may limit or prevent the use of certain Platform features (e.g. they will not be able to check in without GPS).
7. PAYMENT ESTIMATES (NON-BINDING)
7.1. Indicative Nature: Rates and financial terms are agreed exclusively between the User and the Logistics Operator. The Platform may display payment calculations or estimates based on:
- Rates configured by the Logistics Operator in the system (e.g. hourly rate, per SKU, per kilometre, per order delivered).
- Time and operational records generated through features enabled by the Logistics Operator.
- Performance metrics and achievement of objectives.
- Bonuses, penalties or manual adjustments applied by the Operator.
7.2. NON-BINDING CHARACTER: The User expressly accepts that:
- The estimates displayed on the Platform are SOLELY INDICATIVE and do NOT constitute an offer, a promise of payment, an acknowledgement of debt or any payment commitment on Druppify's part.
- The actual payment may differ from the estimate due to adjustments, bonuses, deductions, recording errors or other factors determined exclusively by the Operator.
- Druppify is NOT responsible for differences between the estimate and the actual payment.
- Any claim regarding payments must be directed to the Logistics Operator, NOT to Druppify.
7.3. Transparency: Druppify endeavours to keep estimates accurate, but does not guarantee their absolute accuracy. The Operator is solely responsible for defining, calculating and paying the Drupper's financial compensation.
8. LIMITATION OF LIABILITY
8.1. Druppify is NOT responsible for:
- Accidents, injuries or damage suffered by the User while carrying out operational activities coordinated through the Platform.
- Payments, remuneration, fees or any financial compensation to the User.
- The User's tax, pension or social security obligations.
- Conflicts, disputes or disagreements of any nature between the User and the Operator or Commercial Principal.
- Availability of services, continuity of coordination or any guarantee of minimum earnings.
- Loss of data, service interruptions, Platform errors or technical failures.
- Improper use of the Platform by third parties or by the User themselves.
- The accuracy of payment estimates or indicative calculations.
9. PROHIBITED USE AND MANIPULATION OF RECORDS
The User undertakes NOT to engage in the following conduct:
- Manipulation of records: Falsifying, altering or manipulating check-in/check-out records, geolocation, photographic evidence, digital signatures or any other operational data.
- Impersonation: Using another User's account or allowing third parties to use their own account.
- Spam or abuse: Sending unsolicited notifications, abusing communication systems or taking actions that overload the Platform.
- Illegal use: Using the Platform for illegal or fraudulent purposes, or purposes that infringe the rights of third parties.
10. PRIVACY AND DATA PROTECTION
The processing, retention, deletion and protection of the User's personal data is governed in full by the Druppify Privacy Policy, which forms an integral part of these T&C.
The User expressly accepts the provisions of the Privacy Policy regarding:
- The types of data collected (personal, operational, technical) and the purposes of processing
- Retention and anonymisation of operational data for system integrity, audit and legal compliance
- Rights of access, rectification, erasure (with limitations) and data portability
- The technical and organisational security measures in place
- Use of GPS geolocation at specific events (check-in/check-out), camera and operational evidence
- Automated processes and algorithms that have NO employment or legal effects on the User
11. TERMINATION AND SUSPENSION OF ACCOUNT
11.1. Voluntary Termination: The User may delete their account at any time from their profile settings or by contacting the official support channels. Deletion will be processed in accordance with the Privacy Policy.
11.2. Suspension by Druppify: Druppify reserves the right to suspend or delete the User's account in the following cases:
- Breach of these T&C
- Fraudulent use or manipulation of records
- False information or fraudulent documentation
- Request by the Logistics Operator on justified grounds
- Court order or requirement from a competent authority
11.3. Effects of Termination: Upon termination of the account:
- The User immediately loses access to the Platform
- Identifiable personal data is anonymised in accordance with the Privacy Policy
- Operational data is retained (in anonymised form) for system integrity
- There is no right to any compensation from Druppify
12. INTELLECTUAL PROPERTY
12.1. Ownership: All intellectual property rights over the Platform (source code, design, trade marks, logos, content) are the exclusive property of Sistemas Tecnológicos Osystems SpA.
12.2. Licence of Use: Druppify grants the User a limited, non-exclusive, non-transferable and revocable licence to use the Platform solely for the purposes described in these T&C.
12.3. Prohibitions: The User may NOT copy, modify, distribute, sell, license or create derivative works from the Platform without express authorisation.
13. AMENDMENTS TO THE T&C
13.1. Right to Amend: Druppify reserves the right to amend these T&C at any time by publishing the new version on the Platform.
13.2. Notification: Substantial amendments will be notified to the User by email and/or push notification at least 3 days in advance.
13.3. Acceptance: Continued use of the Platform after the new T&C come into force constitutes tacit acceptance of them. If the User does not agree, they must stop using the Platform and delete their account.
14. SUPPORT AND TECHNICAL ASSISTANCE
14.1. Support Channels: Druppify will provide Users with support and technical assistance in relation to the use of the Platform, and Users may get in touch through the official channels indicated in the app and on the website.
14.2. Scope of Support: Support covers only technical and functional aspects of the Platform (access, registration, use of features). Queries about payments, employment terms or contractual matters must be directed to the Logistics Operator.
14.3. Nature of Support: The support and technical assistance provided by Druppify do not constitute direction, supervision, operational control, performance appraisal or any employment instruction in relation to the User.
15. ACCEPTANCE AND CONSENT
By ticking the "I accept the Terms and Conditions" box and/or by clicking "Register" or "Continue", the User declares that:
- They have read, understood and fully accept these T&C.
- They have read and accept the Privacy Policy .
- They authorise the processing of their personal data as described in both documents.
- They accept the use of GPS geolocation at specific events and of the camera for the purposes described in the Privacy Policy.
- They understand that Druppify is NOT their employer, does NOT process payments and does NOT define working conditions.
- They are over 18 years of age and have the legal capacity to enter into contracts.
